Use this form if you are a citizen or lawful permanent resident of the United States who needs to establish their relationship to certain alien relatives who wish to immigrate to the United States. Who is Eligible?

Who is Eligible?

If you are a U.S. citizen, you must file a separate Form I-130 for each eligible relative.

You may file Form I-130 for:  

  • Your spouse;
  • Your unmarried children under 21 years of age;
  • Your unmarried sons or daughters 21 years of age or older;
  • Your married sons or daughters of any age;
  • Your brothers or sisters (you must be 21 years of age or older); and
  • Your mother or father (you must be 21 years of age or older).

If you are a lawful permanent resident of the United States, you must file a separate Form I-130 for each eligible relative.

You may file Form I-130 for: 

  • Your spouse;
  • Your unmarried child under 21 years of age; and
  • Your unmarried son or daughter 21 years of age or older.

HOW to FILL THE FORM I-130?

Answer all questions fully and accurately. If a question does not apply to you (for example, if you have never been married and the question asks, “Provide the name of your current spouse”), type or print “N/A,” unless otherwise directed. If your answer to a question which requires a numeric response is zero or none (for example, “How many children do you have” or “How many times have you departed the United States”), type or print “None,” unless otherwise directed.

DOCUMENT CHECKLIST
If you are a U.S. citizen: 
  • A copy of your birth certificate, issued by a civil registrar, vital statistics office, or other civil authority showing that you were born in the U.S.
  • A copy of your naturalization certificate or certificate of citizenship issued by USCIS or copy of Form FS-240, Consular Report of Birth Abroad (CRBA), issued by a U.S. Embassy or U.S. Consulate;
  • A copy of your unexpired U.S. passport; or an original statement from a U.S. consular officer verifying that you are a U.S. citizen.

If you are a lawful permanent resident:

If you are a lawful permanent resident, you must file your petition with a copy of the front and back of your Permanent Resident Card. If you have not yet received your card, submit copies of your passport biographic page and the page showing admission as a lawful permanent resident, or other evidence of permanent resident status issued by USCIS

What Happens After Filing Form I-130
Thats the first step in obtaining permanent residence in the United States. I-130 processing time will vary significantly based on the type of relationship between petitioner and beneficiary.

The approval process can take anywhere from 5-12 months for Immediate Relatives and could take several years for Family Preference Categories.

You can check your case status online with your receipt number. USCIS website lists normal processing times for an I-130 petition.
